Trading in Lajpat Nagar since 1969. In these terms, "we" and "the shop" mean Elite Furnishers, and "you" means the person placing an order or using the site.

Accepting these terms

By placing an order you accept these terms. If you do not accept them, please do not order. We may change them, and the version published here when you place your order is the one that applies to that order. Changes are never applied backwards to an order already placed.

You must be at least 18 years old to buy from us, because a contract with a minor is not enforceable under the Indian Contract Act 1872.

Prices, and what is included

• All prices are in Indian rupees and include GST at the applicable rate. No separate tax is added at checkout.
• Delivery is charged separately where it applies. What it costs is set out on our Shipping and Delivery page and is shown before you pay.
• The price you pay is the price shown at the moment you confirm the order.
• Nothing appears for the first time at the payment step. Anything payable is in the basket before you commit.

Furniture prices move with material costs, so a price quoted today may not hold indefinitely. Once you have placed an order, the price of that order is fixed.

When a contract is formed

Adding something to your basket does not create a contract. Nor does the acknowledgement shown after checkout, which only tells you we have received the order. The contract is formed when we accept your order, which we do by confirming the item is available and, where payment is taken online, that the payment has succeeded.

If we cannot accept your order, for example because the last one has just sold in the shop, or because a price was listed wrongly, we will tell you and refund anything you have paid in full. This is how an online listing works in Indian contract law: the listing is an invitation to offer, your order is the offer, and our acceptance completes the contract.

Stock, photographs and natural materials

• We sell from a physical shop as well as online, so an item can sell in person between your order and our acceptance. If that happens we tell you and refund you in full.
• Photographs show the model, not the individual piece. Screens render colour differently, and fabric and finish batches vary.
• Solid wood and cane vary by nature. Grain, colour and small marks differ from piece to piece. That is a property of the material and not a defect.
• Dimensions are given to the nearest practical measurement and may vary slightly. Please measure your doorways and lift before ordering large items.

Made to order and custom pieces

Custom wood pieces are made for you after you order and cannot be resold to anyone else. Once we have accepted a custom order and begun work, it cannot be cancelled and the deposit is not returnable. Please confirm the size, wood and finish with us before you pay.

Returns, refunds and cancellations

We do not offer returns, refunds or exchanges because you have changed your mind, and an order cannot be cancelled once we have accepted it. Furniture and mattresses are bulky, made in finishes and sizes chosen by you, and a mattress cannot be resold once it has been in a home. Please measure your space, check the finish, and ask us anything before you order. We would far rather answer a question than take a piece back.

That is our commercial policy, and it does not touch the rights the law gives you, which we could not remove even if we wanted to:

• If an item arrives damaged, faulty, or is not what you ordered, tell us within 48 hours of delivery and we will repair it, replace it, or refund it. That is your right under the Consumer Protection Act 2019 and the Sale of Goods Act 1930 and it is not affected by anything above.
• If we cannot supply what you ordered, or we cancel the order ourselves, we refund you in full.
• If a payment is taken and the order is not accepted, the money comes back to you in full.

Where we do owe you a refund, it goes back by the same method you paid with, through Razorpay, and typically reaches your bank within 5 to 7 working days of us initiating it. We never ask for your card details to process a refund, and nobody from the shop will ever telephone you for them.

Payment

Online payments are handled by Razorpay, a payment aggregator authorised by the Reserve Bank of India. Your card, UPI or net banking details go directly to Razorpay. They never reach this website or our database, and we never store card details.

We also accept payment at the shop. If a payment fails or is reversed before delivery, we are not obliged to deliver the goods.

Delivery and risk

Delivery times, areas and how delivery is arranged are on the Shipping and Delivery page. Times given are honest estimates, not guarantees, unless we have confirmed a specific date to you in writing.

Risk passes to you when the goods are delivered to the address you gave, not when they are dispatched. Loss or damage in transit is the responsibility of the transport company, not ours. If an item arrives damaged we will repair or replace it, and we will help you claim against the transport company. Please check your item on delivery and tell us about visible damage within 48 hours.

Warranties

Manufactured goods carry the manufacturer's own warranty. Supreme and Sleepwell products are covered by the warranty those companies publish for the model you bought, and we will help you make a claim.

Your rights under the Consumer Protection Act 2019 and the Sale of Goods Act 1930 sit on top of any manufacturer warranty and are not replaced by it. Goods must match their description and be fit for their ordinary purpose. Nothing in these terms takes away a right the law gives you.

Antique and reclaimed pieces are sold in their current condition, with the marks and repairs of their age. Those are described honestly on the product page and are not defects.

Limits on our liability

We are responsible for loss that is a foreseeable result of our breaking these terms. We are not responsible for business losses, loss of profit, or losses we could not reasonably have foreseen.

Except where the law does not allow it to be limited, our total liability for any order is limited to the amount you paid for that order.

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else Indian law does not permit to be excluded. The Consumer Protection Act 2019 does not allow a trader to contract out of its product liability provisions, and we do not attempt to.

Content on this site

The text, photographs and design of this site belong to us or are used with permission. You may not copy them for commercial use without our written permission. Brand names and logos belong to their owners.

Where any part of this site carries content submitted by users, we act as an intermediary under section 79 of the Information Technology Act 2000. If you believe content here infringes your rights or breaks the law, write to our grievance officer with enough detail to identify it and we will act on it. We do not endorse content we did not write.

Your account

You do not need an account to order; guest checkout is available. If you create one, keep your password to yourself and tell us if you think someone else has used it.

You can delete your account at any time from your account page, by entering your password and typing DELETE. We may also delete an account on request or where it is being misused. Deleting an account removes your sign-in, profile, saved addresses, basket, sessions and two-step verification. Any unpaid order is cancelled. Records of paid orders and their invoices are kept, no longer linked to a sign-in, because tax law requires us to keep them.

Using this website

Please do not attempt to break into the site, scrape it at a rate that degrades it for other people, interfere with its security, or use it to send anything unlawful. We keep security records of sign-ins and account changes so we can spot and stop misuse, and we may suspend an account being used this way.

We try to keep the site available but we do not promise it will never be down, and we may take it offline for maintenance.

Circumstances beyond our control

We are not liable for delay or failure caused by something genuinely outside our control: natural disaster, fire, flood, epidemic, war, riot, strike, a government order, failure of the power grid or the public internet, or the failure of a carrier or payment provider we could not reasonably have avoided. If such an event continues for a long time, either of us may cancel the affected order and we will refund you in full.

If something goes wrong

Please contact us first. Most problems are settled quickly by phone. Our grievance officer and the timelines we work to are on the Grievance Redressal page.

Nothing here stops you going to a Consumer Commission. Under the Consumer Protection Act 2019 you may complain to the District Consumer Disputes Redressal Commission where you live or work, which is a deliberate consumer protection and one we do not ask you to give up.

Governing law and jurisdiction

These terms are governed by the laws of India. Subject to your right under consumer law to approach a Consumer Commission where you live, the courts at New Delhi have jurisdiction.
